1. Acceptance of Terms

By downloading, installing, or using the Topi iOS application or website (https://topi.app), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, do not use the app.

These Terms constitute a binding agreement between you and Ashot Tatian, Individual Entrepreneur, registered in the Republic of Armenia.

2. Description of Service

Topi is an iOS application that shows users the best rated places (restaurants, cafes, bars, nightlife venues, sights, street food, parks, spas, markets, entertainment venues, gyms, beauty salons, flower shops, dessert establishments, and kids & family venues (playgrounds, zoos, aquariums)) within a 1 km radius of their current location. Rankings are generated using Google Places data processed through an AI algorithm powered by Anthropic Claude. The app is available on the Apple App Store.

Free tier: Any user (including guests, no account required) can search across all 16 categories. Every new device receives one complimentary full search — showing all 5 AI-ranked places, identical to Topi Pro. After the complimentary search is used, free results show the #1 place only — name, rating, distance, open/closed status, and price level. Places #2–5 are visible as locked cards with a Topi Pro upgrade prompt. The complimentary search is tracked on-device via the iOS Keychain.

Topi Pro unlocks all 5 AI-ranked places per search, unlimited searches, saved favourites, and search history — so you can save and revisit places you’ve discovered.

3. Account Registration

  • No account is required to use the free tier. Guests can search and view the #1 place in any category without registering.
  • Creating an account is required only to subscribe to Topi Pro. A free account links your purchase across devices.
  • You must be at least 13 years old (or 16 in the EEA) to create an account.
  • You are responsible for maintaining the security of your credentials.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

4. Complimentary Search

4.1 One Free Full Search Per Device

Every new installation of Topi includes one complimentary full search. During this search, the user receives all 5 AI-ranked places — the full Topi Pro experience. The complimentary search is available to all users, including guests (no account required).

4.2 How It Is Tracked

The complimentary search is tracked by a boolean flag stored in the iOS Keychain on the user's device. It is not tied to an Apple ID or Topi account. It is consumed on the first successful AI-ranked search and cannot be reset through normal app usage. Reinstalling the application may restore the flag depending on the user's iCloud Keychain settings.

4.3 Scope and Limitations

The complimentary search applies once per device installation context. It is not a recurring benefit. After the complimentary search has been used, the standard free tier applies: the #1 place only per search. Topi Pro subscription is required for unlimited full-access searches.

5. Subscriptions and Payments

5.1 Premium Subscription

  • Monthly plan: $4.99 per month.
  • Annual plan: $47.99 per year (approximately 20% saving compared to monthly).
  • Premium includes: all 16 search categories, all 5 AI-ranked places per search, unlimited searches, saved favourites (bookmark places to revisit), and search history.
  • No free trial is offered. Subscriptions begin immediately upon purchase and auto-renew unless cancelled at least 24 hours before the renewal date.
  • All purchases are processed by Apple via In-App Purchase (StoreKit 2). We do not handle or store payment card data.

5.2 Auto-Renewal

Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. To cancel: go to iOS Settings → [Your Name] → Subscriptions → Topi.

5.3 Cancellation and Refunds

You may cancel your subscription at any time through iOS Settings → [Your Name] → Subscriptions → Topi. Cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused time. For refund requests, contact Apple directly.

EU/EEA consumers may be entitled to a 14-day right of withdrawal under Directive 2011/83/EU. By activating a subscription, you expressly request immediate performance and acknowledge that your right of withdrawal applies only to the unused portion of the service.

5.4 Price Changes

We reserve the right to change subscription prices with reasonable advance notice. Continued use after a price change constitutes acceptance of the new price.

6. Acceptable Use

You agree not to:

  • Reverse-engineer, decompile, or disassemble the app.
  • Use the app for any illegal purpose or in violation of applicable law.
  • Scrape, crawl, or automate requests to our backend services.
  • Create multiple accounts to obtain additional free trials.
  • Attempt to gain unauthorised access to our systems or other users' accounts.
  • Resell, sublicense, or commercially exploit the app without our written consent.

7. Intellectual Property

All content, design, code, trademarks, and logos within Topi are the property of Ashot Tatian, Individual Entrepreneur or our licensors. These Terms do not grant you any ownership rights.

8. Third-Party Services and Data

Topi uses Google Places data, which is subject to Google's Terms of Service (https://policies.google.com/terms). Place information, ratings, and reviews originate from Google and may not always be accurate, complete, or current. We make no warranties regarding the accuracy of third-party data.

Navigation links within the app open third-party mapping applications (Apple Maps, Google Maps, Yandex Maps, 2GIS). Use of those applications is governed by their respective terms.

9. AI-Powered Features

Topi uses the Anthropic Claude API to rank nearby places by quality signals (rating, review volume, review authenticity). AI ranking is used to determine the order in which places are shown. AI-generated content:

  • Is provided for informational purposes only and does not constitute professional advice.
  • May contain errors or inaccuracies.
  • Should not be the sole basis for decisions about visiting a place.
  • AI ranking reflects quality signals at the time of search and may not capture very recent changes.

We disclose the use of AI in accordance with Apple App Store Review Guidelines and Anthropic's usage policies.

10. Disclaimer of Warranties

Topi is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that: (a) the app will be uninterrupted or error-free; (b) place information will be accurate or up to date; (c) AI rankings will always reflect the most current place quality.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Ashot Tatian, Individual Entrepreneur shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of Topi.

Our total aggregate liability to you shall not exceed the amount you paid us in the 12 months preceding the claim, or USD $10, whichever is greater.

12. Indemnification

You agree to indemnify and hold harmless Ashot Tatian, Individual Entrepreneur from any claims, damages, or expenses arising from: (a) your use of the app; (b) your violation of these Terms; (c) your violation of any third-party rights.

13. Termination

We may suspend or terminate your access if you violate these Terms, including attempting to circumvent the complimentary search limitation. Upon termination, your right to use the app ceases immediately. Sections 7, 10, 11, 12, and 14 survive termination.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Armenia. Disputes shall be resolved by the competent courts of the Republic of Armenia.

For EU/EEA consumers, mandatory consumer protection laws of your country of residence apply. The European Commission's Online Dispute Resolution platform is available at https://ec.europa.eu/consumers/odr.

15. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via in-app notification or email at least 14 days before changes take effect.
